By accessing or using Bookr ("we," "us," or "our") website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

1. Our Services

Bookr provides professional publishing services including but not limited to: KDP account setup, multi-platform distribution, editing services, cover design, interior formatting, marketing consultation, book trailer creation, and review packages. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

2. No Guarantee of Sales or Success

IMPORTANT DISCLAIMER:

Bookr does not guarantee any specific level of sales, revenue, royalties, bestseller status, or commercial success. Publishing outcomes vary significantly based on numerous factors including but not limited to: book quality, genre competition, marketing efforts, pricing, reader demand, and marketplace conditions. Our services are provided to improve your book's presentation, discoverability, and professional appeal, but we cannot promise or guarantee any particular financial result or sales performance.

3. No Guarantee of Reviews

While we strive to deliver the number of reviews specified in your selected package, we cannot guarantee the exact number, timing, star rating, or sentiment of reviews. Reviews are provided by real, independent readers who provide honest feedback. We cannot control the content, rating, or tone of any review. Additionally, we cannot guarantee that reviews will remain on any platform, as platforms may remove reviews for various reasons beyond our control.

4. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

6. Payment Terms

Payment for services is required as follows:

  • Service requests require payment approval before work begins
  • Upon request approval, payment of the stated amount is required to begin your service
  • All payments are non-refundable once work has commenced on your project
  • Prices are subject to change without notice, but quoted prices will be honored for approved requests
  • We are not responsible for any bank fees, currency conversion fees, or transaction charges

7. Refund Policy

Due to the nature of our services (digital delivery, personalized work, and reader engagement), we do not offer refunds once work has begun on your project. If we fail to deliver the agreed-upon service within the stated timeframe, you may request a partial or full refund at our discretion. Refund requests must be submitted in writing to publishing@bookrpublishing.space.

8. User Responsibilities

You agree to:

  • Provide accurate and complete information when requesting services
  • Ensure you have all necessary rights to the content you submit (including copyright ownership)
  • Respond promptly to our communications to avoid delays
  • Not use our services for any illegal or unauthorized purpose
  • Comply with all applicable laws and platform guidelines (Amazon KDP, Apple Books, etc.)

9. Intellectual Property

You retain all ownership rights to your manuscript and book content. Any deliverables created by Bookr (cover designs, formatted files, marketing plans, etc.) are licensed to you for use with your book upon full payment. We retain the right to use completed work in our portfolio unless you request otherwise in writing.

10. Platform Compliance

Our review packages comply with Amazon, Goodreads, Apple Books, and other platform guidelines. However, these platforms may update their policies at any time. While we strive to maintain compliance, we cannot guarantee that reviews will not be removed or that platforms will not take action against your account. You agree to hold Bookr harmless for any platform actions taken against your account.

11. Delivery Timelines

Delivery estimates provided (e.g., 3-5 business days, 30-45 days) are estimates only and not guarantees. Delays may occur due to complexity, reader availability, platform processing times, or unforeseen circumstances. We will communicate any significant delays promptly.

12. Limitation of Time to File Claims

ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES MUST BE FILED WITHIN ONE YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE, OR ELSE IT SHALL BE FOREVER BARRED.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of our services after any changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
